1. Scope and seller
These terms govern all orders placed through this website with Tealogian (sole proprietorship), 1209 Geneva (Petit-Saconnex), Switzerland ("Tealogian", "we"), see the legal notice.
2. Products
We sell loose-leaf teas and botanical infusions. They are foodstuffs: store them dry, away from light and strong smells. Photographs are illustrative; as natural products, leaf shape and colour vary from batch to batch and season to season. Certain specialities (e.g. insect-processed teas and some botanicals) are available for delivery within Switzerland only.
3. Prices
All prices are in Swiss francs (CHF) and are final prices, we are not VAT-registered, so no Swiss VAT is added. Shipping is a flat CHF 16 within Switzerland, Liechtenstein and Europe, CHF 20 to the United States and CHF 25 to all other destinations; orders of CHF 150 or more ship free. The rate is shown in the cart before you place your order. The minimum order value is CHF 50. Prices may be displayed in your local currency, converted at the current daily exchange rate, for convenience; the binding price and the amount charged are always the CHF amount.
4. Ordering and conclusion of contract
The cart sends us your order by email or WhatsApp, it is an offer by you, not yet a contract. We confirm availability, the total price including shipping, and payment details personally, in writing. The contract is concluded when we send that confirmation. We may decline orders (e.g. sold-out lots).
5. Payment
Payment is settled personally when we confirm your order, by email or WhatsApp (e.g. bank transfer or TWINT). Goods are dispatched after receipt of payment unless agreed otherwise.
6. Delivery
Swiss orders are shipped from within Switzerland; orders to Europe and the rest of the world are dispatched from France. Indicative delivery times: Switzerland 1–3 working days, Europe 4–10 working days, rest of the world 7–21 working days. Deliveries within the EU are dispatched from inside the EU, so no import charges arise; for other destinations outside Switzerland, import duties, taxes and customs fees of the destination country may apply and are payable by the recipient, they are not included in our prices.
7. Right of withdrawal
Consumers in the EU, the EEA and the UK may withdraw from a distance purchase within 14 days of receiving the goods, without giving reasons. To exercise the right, notify us within that period (email is enough; you may use the model form below) and return the goods within 14 days of your notice. Return shipping is at your cost. We refund the price and standard outbound shipping within 14 days of receiving the returned goods or proof of return.
Exception for foodstuffs: tea that has been unsealed after delivery is excluded from withdrawal for reasons of hygiene and food safety (Art. 16(e) of Directive 2011/83/EU). Only unopened packs can be returned.
Switzerland: Swiss law provides no statutory right of withdrawal for online purchases. As a gesture of goodwill, we nevertheless accept returns of unopened packs within 14 days of delivery, notify us by email first; return shipping is at your cost.
Model withdrawal form (complete and send via our contact form): "I hereby give notice that I withdraw from my contract of sale of the following goods: … / Ordered on … / received on … / Name and address of consumer / Date."
8. Defects
Please check the goods on arrival and report transport damage or wrong deliveries promptly. Statutory warranty rights apply; for consumers in the EU/EEA/UK, the mandatory guarantees of your country of residence remain unaffected.
9. Liability
We are liable without limit for intent and gross negligence and under mandatory product-liability law. Beyond that, liability for slight negligence is excluded to the extent permitted by law.
10. Applicable law and forum
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Geneva. If you are a consumer habitually resident in the EU/EEA/UK, the mandatory consumer-protection provisions and competent courts of your country of residence remain reserved. The EU online-dispute-resolution platform is available at ec.europa.eu/consumers/odr; we do not undertake to participate in ADR proceedings.
